In the future, there will essentially be three paths for the immigration of skilled workers to Germany:

Qualification:

With the EU blue card, IT specialists, for example, who are currently in particularly high demand in Germany, can already come to Germany with recognized qualifications. For them, the salary threshold is lowered, the length of professional experience is reduced and proof of German language skills is waived. In the future, the rule will be that anyone with a degree can pursue any qualified occupation.

Experience:

In the future, anyone with at least two years of work experience and a vocational qualification acquired abroad and recognized by the state there can come as a skilled worker. The qualification no longer has to be recognized in Germany beforehand. This means less bureaucracy and thus shorter procedures.

A salary threshold will ensure that these skilled workers have good long-term prospects on the labor market. Those who do not reach the necessary salary threshold must continue to have their professional qualifications recognized. To ensure that the recognition process does not delay the start of employment, the possibility of a recognition partnership between employees and employers will be created.

Potential:

An opportunity card will be introduced for people who do not yet have a concrete job offer but who have potential for the labor market. This is based on a points system. The criteria include qualifications, knowledge of German and English, work experience, reference to Germany, age and potential of life or spouse.

Further hurdles are being lowered

At the same time, further hurdles for the immigration of skilled workers from third countries will be lowered. For example, the so-called Western Balkans regulation is to be abolished and the quota doubled.

This means that in future up to 50,000 nationals from the six Western Balkan states of:

Albania,

Bosnia and Herzegovina, Kosovo,

Montenegro,

northern Macedonia

and Serbia will be allowed to immigrate to Germany each year.

They can enter Germany for any employment without having to prove professional qualifications.

IT specialists, who are currently in particularly high demand in this country, can already come to Germany without a recognized qualification. For them, the salary threshold will be lowered, as will the length of professional experience required. In addition, IT specialists will no longer have to prove their German language skills in the future.

The following amendments were introduced in the parliamentary procedure:

  • The minimum salary threshold for the issuance of the EU Blue Card for regular professions will be lowered to 50 percent of the annual contribution assessment ceiling in the general pension insurance Anual assessment limit 01.01.2023:                                                                                   7,100 per month in the new federal states (2022: 6,750 euros) and 7,300 per month in the old federal states (2022: 7,050 euros).
  • Asylum seekers who entered the country before March 29, 2023, and who, among other things, have a relevant qualification and a job offer or are already in a relevant employment relationship, will be able to terminate their asylum procedure by withdrawing their application and apply for a residence permit as a skilled worker without having to leave the country and go through a visa procedure beforehand.
  • Furthermore, in the future, the parents of a skilled worker should also be able to be granted a residence permit for family reunification. The same applies to the parents-in-law of the specialist if their spouse is permanently resident in Germany.
  • In addition, among other things, the possibility of extending the opportunity card by up to two years is provided for if the foreigner has an employment contract or a binding job offer for domestic qualified employment and the Federal Employment Agency agrees.
    The law was passed in the Bundesrat on July 7, 2023.
