New plans by the goverment – The legalization plans are becoming concrete:

Germany passed a new cannabis law in early 2017 that allows doctors to prescribe medical cannabis to patients with certain medical conditions. The law came into effect in March 2017 and made Germany the latest in a growing number of countries to legalize medical cannabis.

Under the new law, patients with serious illnesses such as chronic pain, multiple sclerosis, or nausea and vomiting associated with chemotherapy, can receive a prescription for medical cannabis. The cannabis must be grown under controlled conditions and meet specific quality standards.

In addition to allowing medical cannabis, the new law also established a government-controlled agency to oversee the cultivation, processing, and distribution of medical cannabis in Germany. The agency is responsible for ensuring that cannabis products meet quality standards and are produced in an environmentally sustainable and socially responsible way.

It’s important to note that while medical cannabis is legal in Germany, recreational cannabis is still illegal. Possession, cultivation, and sale of recreational cannabis can result in fines, imprisonment, or other legal penalties.

In addition, so-called cannabis social clubs will be legalized

These clubs provide their members with cannabis products from their own cultivation. This model already exists in Spain and Malta.

No general free sale of cannabis

In order for the EU to approve the German legalization of cannabis, however, there will initially be no general free sale of cannabis products, unlike previously planned. Rather, dispensing in licensed stores is planned only in regional model projects, which are limited to five years.

In the regions concerned, scientific studies are then to be carried out to determine the effect of legal sales on consumption and the black market. Lauterbach wants to present the concrete plans on Wednesday.

Release in the coalition agreement agreed

In their coalition agreement, the SPD, Greens and FDP had agreed: “We introduce the controlled distribution of cannabis to adults for consumption purposes in licensed stores.” In his key points from last year, Lauterbach had proposed that the drug and the active ingredient tetrahydrocannabinol (THC) no longer be legally classified as narcotics in the future.

From the beginning, however, it was feared that the project could fail due to international law or at least be thwarted by it.

For example, in the “Schengen Implementation Convention”, the states of the Schengen area have undertaken to “prevent the illicit export of narcotic drugs of all kinds, including cannabis products, and the sale, procurement and distribution of such drugs by administrative and criminal means”.
